When you set up a Dutch company, one of your main concerns may be how to relocate your non-EU staff to the Netherlands.
The necessary steps you must do to relocate your staff to the Netherlands is to secure a work and residency visa for your non-EU employee, whether they will work there for your branch or for your customers. There may be exceptions, notably for brief business visits that are made up entirely of meetings.
The relocation of non-EU staff to the Netherlands may be simpler than you think (EU employees are free to work in the Netherlands), particularly in the following two situations:
- Your employee has been employed by your company (abroad) for at least three months and is paid at the senior level (in 2022, this pay was fixed at € 4.840,00 for employees over 30 and € 3.549,00 for employees under 30 at the time of application).
- Your employee holds a university degree and makes a minimum of €5.670,00 in gross wages (in 2022, the amount is annually increased).
In these instances, the IND will issue the work permit if the employee satisfies the objective requirements. The ICP system would be ideal in the first scenario. It is a reasonably quick process and does not require a recognized Employer (approximately eight weeks, although for recognized employers, it can be done even within two weeks).
The EU Blue card might be the best choice in the second case. Although it can take months to complete this process.
